6 Spanish residency permit advantages!

Following the last month's article (Spanish Residency Authorisation: Time is running out!), we are now up to the last day for British citizens to take advantage of all the advantages that the transition period has to offer when applying for a Spanish residency. We strongly advise all UK nationals now, before the end of the year, if possible, to apply for residence permits. By 2021, the requirements for the application will be much harder, and many will no longer be eligible.

To make matters more complicated, it would seem that the U.K. authorities are heading for a no-deal Brexit, which would put even more pressure on you to get this done and done whilst you can. Immigration authorities have strengthened the requirements for a new change from November on the Spanish side, which now categorically requires the applicants to prove their habitual residency in Spain. This, besides the one we reported in July 2020, is the second big change in 2020.

Please take note of the large number of rights given to us since the United Kingdom has been a member of the Union for the last 47 years; but they will no longer be available for everyone who did not get a residence permit from 2021, so please do not take them for granted, and be proactive for your own sake.

As a national of a Member State of the Union you must now apply for a Spanish residence and make sure that you secure your European rights before it is too late.

Six Spanish residence permit benefits

Free movement within the Schengen Area

You are allowed unrestricted access throughout the Schengen area with a Spanish residence permit. Avoid pesky passport checkups, avoid multiple visa requests, avoid long queues. A visa-free access permit is available to you in all 26 Schengen countries.

Right in Spain to live (Europe)

Again, most UK nationals accept this for granted, but this will be far more challenging in a post-Brexit world. A residency permit legally allows you to remain unchallenged within the Union territory and live your lives. Illegal aliens who do not have a valid residency permit and who spend over the 90-day period may be deported to their country of residence.

Work right

A residency permit allows you to usually search for a job. Employers in Spain are going to ask job seekers to show that they are legally in Spain to avoid major fines for the hiring of illegal immigrants.

Right to learn

Students can live and study in Spain through residency permits (Europe).

Voting right

Say on local elections, vote to improve things in your town for a mayor.

Right to healthcare (S1)

Once you have obtained a Spanish residency permit, UK pensioners may request that their accrued UK health rights be fully transferred to Spain through the S1 procedure. You can use the Spanish healthcare system in equal rights to all indigenous persons as long as you remain in Spain. This service is available at a flat rate: Transfer of healthcare rights (S1 – Registration of Social Security).

Finishing line

Any EU national living more than 90 consecutive days in Spain must, by law, apply for a Spanish residence permit.

Please note that within the Spanish territory, you may legally stay for a maximum of 90 days, each rolling six-month period within one calendar year.

At the end of the Brexit transition period, British nationals are important to achieve a Spanish residence permit, using the lenient conditions currently in place while they are in existence.

You should be advised that it takes several weeks to achieve a Spanish residence permit (in Malaga), so please plan ahead. What matters is that you file it before the deadline of 31-12-2020.

Please do not sleep on it for your own sake, as the clock is ticking.
